Requirements To Meet To Hire Foreign Workers

Most governments grant their citizens the right to hire foreign workers if they chose to do so. This is however on the condition that they observe the compliance rules and regulations that have been put down as concerns hiring immigrants. They may be hired for all kinds of jobs and on either permanent or temporary basis.

Compliance is done both by those wishing to recruit foreigners and the concerned government authorities. The government side will see to it that the positions being offered are genuine. They also verify the terms of employment including wages. The government also has to keep a check on the numbers to ensure that job opportunities for nationals are not adversely affected.

Employers are required to obtain certification documents from the labor department. It is granted where it is shown that there is indeed a job vacancy and that there are no or very few citizens who would want to take the job for the wages being offered. Upon an application being approved, the employer is required to obtain a visa for the alien worker. However, application approval is not a guarantee that a visa will be issued. The government must undertake to ensure that there is nothing barring their entry to the foreign country such as a criminal record.

The visa application will be determined by the job in question. Visa categories vary depending on the job such as whether it is domestic, agricultural, professional, permanent, temporary or specialized jobs. Special jobs include modeling, performing at a circus and performing as a music artist or other forum such as on stage.

Should the visa be granted, the government still follows up. One thing they will do is ensure that the worker gets paid as was agreed on and that the job they will do is as it was indicated in applying for the work permit. If this is not adhered to, such as less or late payments, complaints can be made to the same government offices.

Employers who satisfy all the requirements are required to keep records of the hours an employee works. It may also be required that a employer keeps note of any hours the employee purposely refused to work without sufficient reason such as being unwell. Employees are given a wage statement that shows the hours they worked, hours they missed work and pay per hour, day or other terms agreed on. Total earnings and any deductions also have to be shown. Those who relocate to take up specialty or professional jobs must also keep records of hours worked, deductions and gross and net pay.

There is a class of immigrants referred to as unlisted foreign workers. These are the immigrants with no legal alien status that seek work to sustain themselves. Despite their not being legally listed as aliens, those who employ them are required to also keep the same records as those of lawful foreign employees.

Generally speaking, most governments do not hinder citizens who wish to hire foreign workers. They will however be stringent for about compliance. This is for the good of both employers who are required to certify the identity and qualifications of the employees they wish to bring in. It is also for the good of employees who can be sure the jobs are genuine, that they will be paid as agreed and that they will have recourse if a problem should arise.
